No Havana Club in USA
Pernod Ricard was rejected by the US Supreme Court in its pursuit of Trademark for Havana Club in the USA.
May 15, 2012. The 17 year battle between Pernod Ricard and Bacardi has been concluded in the United States... for now. This week, the Supreme Court rejected Pernod Ricard's right to sell Havana Club in the USA. Neither Bacardi nor Pernod Ricard walk away with the trademark for the USA.
The case is strange because it is illegal to sell Cuban-made liquors in the USA due to the USA's trade embargo against Cuban products. The fight for the right to the trademark would have been just that, a fight for trademark - not for the ability to sell the rum.
